The problem with the Nigerian system remains the fact that merger control is not really viewed, as it should, from the prism of antitrust or competition protection, but more from the prism of securities regulation. SEC is not an antitrust body but a securities regulator. Can the SEC effectively be both a securities regulator and a guardian of competition (the role played by a competition authority)?
